This Privacy Policy describes how Big Break Inc. collects, uses, and shares your personal information when you use the Big Break platform.
01Our Promise to Creatives
Big Break was built creator-first. That means your data exists to protect you — not to be monetized, resold, or exploited.
We collect only the information necessary to operate the platform, pay Creatives accurately and on time, and protect against fraud and abuse.
We do not sell personal data, license creative work, train artificial intelligence models on private content, or treat your information as a product.
02What Big Break Will Never Do
Big Break will never: — Sell or rent your personal information — Claim ownership over your creative work — Use your portfolio or private content to train AI models — Share your private messages without your consent or legal requirement — Discriminate against you for exercising your privacy rights
I. What Information Do We Collect?
Account information: When you create an account, we collect your name, email address, username, password, and profile information.
Payment information: To process payments through The Reserve, we collect bank account information from Creatives (for payouts) and payment method information from Curators (for funding projects). Full payment details are handled by Stripe.
Project information: When you use Big Break to hire Creatives or offer services, we collect project descriptions, requirements, deliverables, timelines, and communications.
Device information: We collect device type, operating system, IP address, browser type, and general location (city/state level) derived from IP address.
II. How Do We Use This Information?
We use your information to: — Create and maintain your account — Connect Creatives with Curators based on project needs — Facilitate Services Agreements and process payments through The Reserve — Enable communication between users — Send transactional notifications (project updates, payment confirmations) — Verify user identities and detect fraud — Comply with tax reporting requirements (1099 forms for Creatives) — Improve the platform and resolve disputes
III. How Is Information Shared?
Between users: Curators can see a Creative's name, profile, portfolio, skills, and approximate location. Creatives can see a Curator's name, company name, and project requirements.
Public profile: Your username, professional title, bio, public portfolio pieces, and city/state are visible to anyone.
Service providers: We share data with Stripe (payments), identity verification services, cloud hosting providers, and customer support tools. All service providers are contractually obligated to protect your data.
We do not share: Your email address, phone number, full bank details, payment card numbers, private messages, or precise location.
IV. Your Choices and Rights
Access and update: You can update your account information at any time in your profile settings.
Delete your account: You can request deletion of your account and personal information. We may retain certain information as required by law (tax records, dispute resolution — typically 7 years).
Marketing: You can opt out of marketing emails by clicking "unsubscribe" or adjusting notification preferences. You cannot opt out of transactional emails (payment confirmations, project updates).
California residents (CCPA): You have the right to know what data we collect, request deletion, opt out of sale (we don't sell data), and non-discrimination for exercising your rights.
European residents (GDPR): You have rights to access, rectification, erasure, data portability, and to lodge a complaint with a supervisory authority.

V. Data Security and Retention
We implement reasonable security measures including TLS/SSL encryption, encrypted data at rest, secure password hashing, access controls, regular security audits, and PCI DSS compliance for payment processing.
Retention periods: — Account information: While active and 7 years after closure — Project data: 7 years after completion — Payment records: 7 years — Support communications: 3 years
No security measure is 100% effective. You are responsible for keeping your account credentials secure.
VI. International Data Transfers
Big Break is based in the United States. If you access our platform from outside the U.S., your information will be transferred to and processed in the United States. For EEA/UK/Swiss users, we rely on appropriate safeguards including Standard Contractual Clauses.
VII. Children's Privacy
Big Break is not intended for users under 16 years of age. We do not knowingly collect information from anyone under 16. If we learn that we have collected information from someone under 16, we will delete the account promptly.
VIII. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of changes by posting the updated policy with a new Effective Date and sending email notification to your registered address.
